This is a note to Kofi Annan from Hans Corell detailing a definition of arbitration as "...an alternative to the more commonly used form of dispute settlement through courts. While courts take their powers from legislation, be it constitutional or otherwise, arbitration functions as a privately established mechanism, where the parties in dispute have the broadest freedom to tailor the dispute settlement process to their needs and expectations, and also to the nature of the dispute". It indicates how this method should be used.
